General terms and conditions of sale
By placing an order, the customer unreservedly accepts these general terms and conditions of sale. The complete and up-to-date Terms and Conditions are available on the website of L'atelier Il était une fois.
Purpose
These General Terms and Conditions of Sale (GTCS) govern the sale of handmade resin figurines by L'atelier Il était une fois, hereinafter referred to as Ledoux Maxim, to its customers.
Products
The products offered for sale are handmade resin figurines created by L'atelier Il était une fois. Each product is accompanied by a detailed description and illustrative non-contractual photographs.
Prices
Product prices are indicated in euros (€) and displayed on the website of L'atelier Il était une fois. They do not include delivery charges, which are calculated and added at the time of the order.
Orders
The customer places an order by selecting the desired products and following the ordering process on the website or through a quotation for custom orders. An order confirmation is sent by email, summarizing the ordered items and the total amount to be paid.
For personalized products, no modifications will be accepted after project validation.
Unless otherwise expressly agreed with the customer before order validation:
The 3D files created by L’Atelier Il Était Une Fois as part of a custom order remain its exclusive property.
L’atelier Il était une fois reserves the right to modify these files, market them, and create other figurines based on these creations.
The customer acquires only the 3D-printed figurine, without any rights to the associated digital file.
If the customer wishes to obtain exclusivity for the creation, they may request it before the finalization of the order. An additional fee may apply depending on the conditions defined with L’Atelier Il Était Une Fois.
If the customer provides a 3D file for customization, they guarantee that they hold all rights of use and authorize L’Atelier Il Était Une Fois to use it exclusively for their order. L’Atelier Il Était Une Fois may not sell or modify this file without the customer’s written consent.
Payment
Payment is made at the time of the order using the payment methods offered on the website or via quotation. The seller guarantees the security of online transactions.
Delivery
Products are delivered to the address provided by the customer when placing the order or to a pickup point near their home. Delivery times are provided for informational purposes only and may vary depending on product availability and the carrier’s logistical constraints.
L'atelier Il était une fois cannot be held responsible for delays caused by the carrier or unforeseen events (force majeure). The customer receives order tracking information by email.
L'atelier Il était une fois declines all responsibility for damage related to transport. Upon receiving a package, whether at home or at a pickup point, the customer must verify the condition and conformity of the order before accepting the package. In the event of damage or anomalies, the customer is invited to refuse the package. Once the package has been accepted, L'atelier Il était une fois can neither refund nor replace the order.
Claims must be submitted within a maximum of 72 hours after receipt of the package and accompanied by visual proof (photos) to allow prompt and appropriate handling of the claim.
Right of Withdrawal
In accordance with current legislation, the customer has a withdrawal period of 14 days from receipt of the products to return them, at their own expense, for a refund or exchange. This right of withdrawal does not apply to personalized products or products made according to the customer’s specifications, in accordance with Article L221-28 of the French Consumer Code.
To exercise your right of withdrawal (when applicable), you may contact us. The returned product must be in perfect condition, in its original packaging, and return shipping costs are the responsibility of the customer.
In the event of mediation proceedings, L’atelier Il était une fois will propose a mediator.
Warranty and After-Sales Service
Products sold by L’Atelier Il était une fois are covered by the legal warranty of conformity. In the event of an issue, the customer may contact after-sales service for assistance.
The warranty for custom figurines remains at the discretion of L’Atelier Il Était Une Fois, depending on the nature of the product and the defect identified.
The figurines are made of resin, a porous material that may present slight irregularities or residues related to the handmade manufacturing process. Minimal traces of 3D printing supports may remain without affecting the overall quality or the handmade and unique nature of each figurine.
Figurines that must be assembled from several parts (specified in the quotation or product description) are glued together. They may display separation lines that do not affect the overall quality or the handmade and unique nature of each figurine.
The above-mentioned irregularities are not covered by the warranty. Assistance may nevertheless be discussed depending on the claim identified by the customer; however, the warranty for custom figurines remains at the discretion of L’Atelier Il Était Une Fois.
Intellectual Property
The products, designs, and photographs offered by L'atelier Il était une fois are protected by intellectual property rights. Any unauthorized reproduction or use is prohibited.
Data Protection
The customer’s personal data is collected and processed in accordance with the privacy policy of L'atelier Il était une fois.
Disputes
In the event of a dispute, the parties shall endeavor to resolve the disagreement amicably. If no amicable agreement is reached, the customer may refer the matter to a consumer mediator. Failing this, the competent courts shall have jurisdiction.
Social Media
Any order placed through the website or directly (for example, a personalized figurine) may be featured in videos and/or photos on the social media accounts of L’atelier Il était une fois.
Modification of the Terms and Conditions
L'atelier Il était une fois reserves the right to modify these Terms and Conditions at any time. The new conditions shall apply to orders placed after they are published online.
